Regarding the retention period, generally, when personal data are no longer necessary for the processing purposes for which they were collected, they will be blocked, being available only to the competent authorities for the possible clarification of legal responsibilities during their processing, always in accordance with applicable regulations, and cannot be used for purposes other than these. After the corresponding legal retention periods in case of blocking, your data will be deleted as provided by the applicable regulations and may also, if applicable, be securely anonymized by Vidodo Guide (anonymized/non-personal data).

WHAT ARE THE CONSEQUENCES OF NOT PROVIDING YOUR DATA?

We strive to request or apply the minimum and essential data for carrying out the personal data processing activities in full development of our purpose and social objectives, all in accordance with the principles contained in the applicable regulations.

However, the lack of provision of your personal data could lead to the impossibility of: 1) navigating our website correctly (disabling technical cookies); 2) processing your specific request or inquiry (for example, due to the lack or insufficient completion of the forms enabled on the platform).

Generally, we do not share your data with third parties, nor do we sell or offer it to them. However, considering the aforementioned purposes, your personal data may be communicated, where applicable, to the following recipients:

Likewise, it is possible that certain third parties may access your personal information in the development of services they may provide to Vidodo Guide. For example, in the case of third-party cookies applied on the platform (see cookie policy).

Vidodo Guide engages various data processors to handle personal data under its control, granting access to such processors as trusted providers and only to the extent strictly necessary for the delivery of the contracted services. These data processors operate under a service contract in terms that include conditions and guarantees outlined in Article 28 of the GDPR. Vidodo Guide conducts the appropriate controls, inspections, and audits in this area to ensure that these data processors strictly comply with the contracts signed for this purpose and the applicable regulations.

We inform you that, generally, international transfers of your personal data are not anticipated. Vidodo Guide adopts the necessary measures and guarantees in this area in accordance with current personal data protection regulations. WHAT ARE YOUR RIGHTS, WHAT DO THEY ENTAIL, AND HOW CAN YOU EXERCISW THEM?

You can exercise your rights of access, rectification, erasure, portability, restriction of processing, and objection by sending a letter to the company’s registered office or by emailing service@vidodoguide.com.  If necessary to verify your identity, you should accompany your request with a copy of your national identity document or equivalent identification document (passport, N.I.E., etc.).

ARE SECURITY MEASURES APPLIED TO PROTECT YOUR PERSONAL DATA?

Considering the nature, scope, context, and the indicated purposes of processing, as well as the risks of varying likelihood and severity for your rights and freedoms, Vidodo Guide implements (and will implement) appropriate technical and organizational measures to ensure the proper security and protection of your personal data. This includes adherence to privacy by design and by default principles and applying a concurrent risk-focused approach that will be reviewed and updated by Vidodo Guide when necessary. The use of the Hyper-Text Transfer Protocol Secure (HTTPS) on our platform is an enhanced guarantee for the security of your personal data.

LOCATION DATA

The application accesses location data to enable navigation and location-based features during active usage. Location information is processed on-device and is not stored, shared, or used for marketing or profiling purposes. Users can disable location permissions at any time through their device settings.

VALIDITY AND MODIFICATIONS OF THE PRIVACY POLICY 

This policy has been in effect since November 15, 2023.

Vidodo Guide reserves the right to modify this policy to adapt it to future legislative, doctrinal, or case law developments that apply, or due to technical, operational, commercial, corporate, or business reasons, informing you in advance and reasonably of the changes when possible. In any case, it is recommended that each time you access this platform, you should carefully read this policy, as any modification will be published through it.

TERMS OF USE

GENERAL TERMS AND CONDITIONS

This Platform is under the ownership of Vidodo Guide S.L. (hereinafter, “Vidodo Guide“ or “we“), an entity with CIF B56188493, domiciled at Calle Benahore, 20, 35571 Yaiza, Las Palmas, Spain, and registered in the Mercantile Registry of Lanzarote, volume 538, folio 193, sheet 13706, with the email service@vidodoguide.com.

1.DESCRIPTION OF SERVICES OFFERED

The Vidodo Guide Web Platform allows customers to consult and purchase products and/or services marketed by the suppliers on the Vidodo Guide website. Transactions conducted through the Vidodo Guide Marketplace are made directly between the customer and the suppliers, in compliance with the precepts and other legal requirements applicable at any given time.

Vidodo Guide does not assume the role of agent/distributor/representative of the suppliers, nor as a reseller of the Products offered by third-party sellers through Vidodo Guide. The products advertised and sold in the Vidodo Guide online store are the exclusive responsibility of the suppliers who sell their products through the Platform, especially regarding their ownership, quality, safety, origin, warranty, and compliance with applicable legislation.

These General Terms and Conditions of Contracting (hereinafter, “GTCC”) apply to the contracting of products advertised through the Vidodo Guide Web Platform by the Client. Therefore, each time you are about to enter into a contract, we recommend a careful and detailed reading of these GTCC, as well as the particular conditions, as they bind the Client, in accordance with the applicable Spanish regulations for these cases.

The contracting implies acceptance of the following:

  • The Client is interested in contracting the products or services offered through the Vidodo Guide Web Platform, possessing the legal capacity to do so. All this in accordance with the terms set out in these conditions.
  • The Client’s express acknowledgment of having read, understood, and accepted, without reservations, these general conditions, made available at all times and prior to contracting.
  • The valid conclusion of a contract between the parties in accordance with these conditions and applicable legislation, and therefore, the Client’s commitment to the payment of the corresponding fees and payments, as it is a sale of products with an obligation of payment.
  • Acceptance by the Client of any notices, regulations of use, and instructions made known at https://vidodoguide.com/. Non-acceptance will be considered by the parties as a withdrawal from these general conditions by the Client, consequently leading to their termination or resolution.
  • The language in which the contract between the parties is formalized and the contracted services are developed will be Spanish.

2. BUYERS

Users wishing to contract goods or services through the platform must be at least eighteen (18) years old or, in the case of minors, legally emancipated, and in any case, have sufficient legal capacity to contract validly. Moreover, the Client declares that all the information provided to access Vidodo Guide, before and during its use, is true, accurate, complete, and precise.

The Client is solely responsible for the veracity and accuracy of the data provided during both the registration and purchase process. However, we may at any time request any necessary accreditation documentation to verify compliance with this condition.

Any interested client can purchase products on the platform. However, additional functionalities are available for users who choose to register.

3. AVAILABILITY AND INFORMATION OF THE GOOD OR PRODUCT

Our platform provides necessary information about the characteristics and availability of the goods and products offered. If at the time of processing your order, for any reason, the product or good is not available, we will indicate this immediately, and in such a case, you will not be charged for it.

Additionally, each good or product is associated with more information typically linked or directly related to specific characteristics and technical sheets, which will be completed by the suppliers. In this regard, such information will be available to customers when they have defined a shipping address.

4. ACCEPTED PAYMENT METHODS OR MODALITIES

You may use the following credit and debit cards as payment methods: credit cards, Apay, GPay. In this regard, you must enter your card details during the confirmation of your order. We adopt enhanced security measures to protect this information through the secure server system we use.

However, we do not accept the following payment methods:

  • Checks or postal money orders.
  • Cash payments in any currency.
  • Promissory notes.
  • Cash on delivery payments.
  • Direct debits.
  • Bank transfers.

If the purchase was effectively made by the cardholder and the demand for reimbursement is not due to the exercise of the right of withdrawal or resolution, the latter will be obligated to Vidodo Guide to compensate for the damages caused as a consequence of such cancellation.

5. PRICES

All prices listed on our platform include legally applicable taxes, with an explicit breakdown provided where required by applicable regulations.

If you fail to fulfill the stipulated contractual obligations, Vidodo Guide may terminate the contract between the parties through written communication, which can be sent via email to the address provided by the customer or user, and retain any amount related to the order that has been paid up to that point, without prejudice to any additional claims for compensation for damages caused to Vidodo Guide.

6. CONFIRMATION OF RECEIPT OF YOUR ORDER

Once you have correctly placed your order within the platform, you can download it through the “Booking details” section.

7. CONTRACT EXECUTION

Once you have received the email confirming the purchase, generally, your product will already be available to you.

In the event of non-execution of the contract by VIDODO GUIDE due to the unavailability of the contracted service, as previously indicated, the customer will be informed of this lack of availability. If this unavailability occurs after the effective contracting, the customer will promptly be refunded any sums or monetary amounts that had been paid under the contract.

8. SHIPPING POLICIES AND COSTS.

8.1. Geographical scope:

Users can purchase products without geographical restrictions.

9. RETURN AND REFUND POLICIES.

To the extent that the products advertised and sold in the Vidodo Guide online store are the responsibility of the suppliers who sell their products through the Marketplace, changes, returns, and refunds will follow the policy set by the supplier (or suppliers if multiple products have been purchased) of the product(s) in question.

This return policy does not affect the legal rights of the customer as provided in Royal Legislative Decree 1/2007 of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws.

If the Customer wishes to cancel a product, the Cancellation Policy to which the Provider of the purchased product has adhered must be followed. In this regard, when purchasing a product, you can view the return and refund policy applicable to it, which must be accepted to formalize the purchase agreement.

Under that premise, if you wish to return a good or product purchased through the platform, provided it is possible under these conditions and applicable law, the return must be requested from the product’s Provider.

However, if the Customer and the Provider have not reached an agreement or if it has been demonstrated that a third party is the cause of the inconvenience, Vidodo Guide will intervene to try to resolve the conflict.

10. LIABILITY.

VIDODO GUIDE will not be liable for:

  • Losses not attributable to any breach on its part;
  • Business losses (including lost profits, income, contracts, anticipated savings, data, goodwill, or unnecessary expenses incurred).
  • Any indirect or consequential losses that were not reasonably foreseeable by both parties at the time the contract for the sale of goods or products was entered into.
  • For any delay or non-fulfillment of its obligations under these conditions if such delay or non-fulfillment results from circumstances beyond the reasonable control of Vidodo Guide or attributable to any third party. This provision does not affect your right to receive the product within a reasonable time in accordance with Spanish legislation.

11. APPLICABLE LEGISLATION AND JURISDICTION.

These general contracting conditions are governed in all their extremes by the applicable Spanish law, and in the case of conflict or divergence in the interpretation and/or execution of the same, or of any other particular conditions, policies, and other legal notices set forth on the platform, the competent Courts and Tribunals of Las Palmas de Gran Canaria will have jurisdiction, renouncing any other jurisdiction that may correspond to the parties. However, when the Customer holds the legal status of a consumer, litigious matters should be submitted to the competent Courts and Tribunals in the consumer’s domicile or the place of obligation fulfillment.

Notwithstanding the ability of customers to submit the appropriate complaint or claim by contacting service@vidodoguide.com regarding the services provided by Vidodo Guide, customers are informed that they can resort to the Online Dispute Resolution Platform developed by the European Commission, in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, on consumer dispute resolution. 12. MODIFICATION OF CONDITIONS, POLICIES, AND LEGAL NOTICES.

Vidodo Guide reserves the right to make changes at any time to its platform, policies, terms and conditions applicable to it or to the sale of goods and products articulated through it, including therefore these General Contracting Conditions. Generally, the user and customer will be subject to the terms and conditions, policies, and contracting conditions in force at the time of contracting, being informed, to the extent that it is reasonably and technically possible, of any projected changes in this area, with sufficient advance notice for proper acknowledgment. If any of these conditions are declared invalid, null, or for any reason ineffective, such condition shall be deemed excluded without affecting the validity or enforceability of the remaining conditions.
